Terms & Conditions Agreement
Term
Month-to-month lease requiring a minimum of thirty (30) days' written notice from either party prior to the expiration of the current month to terminate.
Rent
Due on the first day of each month. Access gate fobs/cards will be disabled and a late fee of $25 invoiced if rent is not received by the 10th. Vehicles and property are subject to towing at the owner's risk and expense if payment is not received by the 25th day. Partial month rents are prorated unless posted otherwise.
Deposit
Requires a deposit equal to monthly rent upon execution. PDX TRUCK PARKING LLC may use this deposit to cure defaults without forfeiting other legal rights/remedies.
Agreement
Valid solely for the designated parking customer.
Cleanliness
Renters must not litter and must keep their assigned space clean and swept. Renters will be invoiced for cleaning costs resulting from non-compliance.
Limitations
Property usage is governed by the following safety and operational guidelines:
- Property access is restricted to access tools only.
- Spaces are strictly for truck/trailer parking.
- All vehicles must be fully operational, licensed, and insured at all times.
- No violation of local, state, or federal laws.
- Equipment brought on-site must not be faulty, leak fluids, or damage the property. Renter assumes liability for all damages, cleanup, repairs, and legal costs stemming from fluid leaks.
- No vehicle servicing, oil changes, fluid services, or repairs on-site by renter or third parties; doing so constitutes a default, rendering equipment subject to towing and agreement termination.
- Prohibits transportation of hazardous materials onto the property, illegal contraband, alcohol, or illegal/legal drugs.
- Renters may not grant access to third parties.
- Maximum speed limit is 5 MPH.
SMS Terms & Conditions & Program Notifications
- Program Description & Opt-In: By checking the SMS consent box during online booking or providing your mobile phone number at checkout, you expressly consent to receive transactional notifications and alerts from PDX TRUCK PARKING LLC. These include reservation confirmations, gate access codes, site entrance instructions, and parking expiration/renewal alerts. Consent to receive SMS messages is not a condition of purchasing parking services.
- Message Frequency: Message frequency varies based on your reservation frequency and upcoming expiration alerts.
- Cost & Fees: Message and data rates may apply depending on your mobile carrier plan. PDX TRUCK PARKING LLC does not charge extra fees for sending SMS messages.
- Opt-Out & Customer Support: You may opt out or unsubscribe from SMS messages at any time by replying STOP to any text message received from us. For assistance, reply HELP or contact customer support at info@pdxtruckparking.com.
- Privacy Policy: Mobile phone numbers and SMS consent data will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Review our complete Privacy Policy at https://pdxtruckparking.com/privacy-policy/.
- Carriers: Mobile carriers are not liable for delayed or undelivered messages.
Liability
Renters agree to defend, indemnify, and hold harmless PDX TRUCK PARKING LLC and its members/agents from liabilities, damages, theft, fires, natural causes, tow charges, or attorney fees arising from property usage.
Remedies
In case of default, PDX TRUCK PARKING LLC reserves all legal and equitable remedies, including termination. Subletting or assigning space without prior written consent is prohibited.
Alterations
No space modifications or improvements are allowed without prior written consent.
Attorney's Fees
Renter is responsible for attorney fees and enforcement costs incurred by PDX TRUCK PARKING LLC in default scenarios.
Changes
The agreement terms are subject to change at any time.
